Abstract

There is freedom granted by the Constitution of the Portuguese Republic that safeguards fundamental rights and freedoms. Freedom of Association is recognized in Article 46 of the Constitution provided such associations are not intended to promote violence and their objectives are not contrary to the criminal law. Currently, the Ministry of Labor and Social Security regulates the formation of POs. This responsibility varies depending on the ruling party. Portugal’s legal framework provides a favorable environment to form associations.
