    This article is the third in a series about electronic discovery in bankruptcy. The first article covered the basics of electronic discovery, including history, rules and resources. The second discussed the discoverability of information found on social media sites such as Facebook, YouTube and LinkedIn, and how these sites can be rich sources of evidence for bankruptcy cases. This article will discuss the application of electronic discovery to bankruptcy practice and examine some recent bankruptcy cases where electronic discovery issues were particularly significant A final article will review current technologies that can assist with electronic discovery before and during litigation, introduce examples where the failure to handle the electronic discovery process properly resulted in sanctions and discuss the lessons that can be learned from these examples.

The third article discussed the application of electronic discovery to bankruptcy practice and examined some recent bankruptcy cases where electronic discovery issues were particularly significant. This final article will review current technologies that can assist with electronic discovery before and during litigation, describe some of the ethical duties of attorneys in electronic discovery, provide examples of cases where failure to handle the electronic discovery process properly resulted in sanctions and discuss the lessons that can be learned from these examples.

    Ethical Issues in IP Law Practice: Where the Rubber Meets the Rules

    Using the race theme and symbols as a way to frame the discussion, this paper will highlight a variety of ethical issues that can emerge throughout the representation of a client in matters related to intellectual property law. These are complicated issues, made even more so by the changing nature of the practice of law, by technology and by the fluid nature of the national and global economy. It would be impossible to capture all of the potential ethical issues that could confront an attorney practicing in intellectual property law in one short paper or presentation. Therefore, this paper will wave a yellow flag over a few topics that are at the intersection between law and technology and that may be common to attorneys who deal with patent, trademark, trade secret and copyright law. The bibliography contains a number of resources that can assist attorneys in other matters related to ethical issues of practicing intellectual property law not covered in the paper.
